“Personal information” included in private information refers to “personal information” as described in the Act on the Protection of Personal Information, meaning information about a living individual that can be used to identify the specific individual by name, date of birth, address, telephone no., contact information, or other description contained in such information.
“Historical information and characteristics” included in private information refers to information other than the above “personal information,” including services used and products purchased, records of webpages and advertisements viewed, keywords used by a user when searching information, dates and times of use, methods of use, usage environments, postal codes, gender, occupation, age, user IP address, information contained in cookies, location information, and device identifier information.
When a user registers to use the Website, the Company may ask for personal information such as name, date of birth, address, telephone no., email address, bank account no., credit card no., or driver’s license no. The Company also may collect from business partners transaction records and payment-related information containing users’ personal information exchanged between users and such partners (including information providers, advertisers, and recipients of advertising; “partners” hereinafter).
The Company collects historical information and characteristics regarding a user when the user uses services or views webpages provided by the Company or a partner. Notwithstanding the provisions of the preceding article, the following cases do not qualify as provision to third parties:
When an individual concerned by personal information has requested its disclosure, the Company shall disclose such information to said individual without delay. However, if such disclosure would result in any of the following cases, the Company may decide not to disclose all or part of such information, and when making such a decision it shall notify the individual of such fact without delay. The Company shall request a fee of 1000 yen/instance for disclosure of personal information.
Notwithstanding the provisions of the preceding paragraph, in principle information other than personal information, such as historical information and characteristics, shall not be disclosed.
If personal information held by the Company concerning him or her is incorrect, a user may, through the Company’s specified procedures, ask the Company to correct or delete such personal information.
When the Company has received a request from a user as described in the preceding paragraph and has determined that it needs to accept such request, it shall, without delay, correct or delete the relevant personal information and notify the user thereof.
When a user has requested the cessation of use or deletion (“cessation of use etc.” hereinafter) of personal information concerning him or her, due to the fact that such personal information is being used beyond the scope of its purposes of use or was collected through improper means, the Company shall without delay conduct the necessary investigation and, based on the results thereof, take steps such as cessation of use etc. of the personal information and notify the user thereof. However, if it would be difficult to take steps such as cessation of use etc. for such personal information because doing so would be highly costly or for other reasons and the Company can protect the user’s rights through other measures, it may take such other measures.
