PRIVACY POLICY

Eiyusai Suigian (“Company” hereinafter) hereby establishes the following Privacy Policy (“Policy” hereinafter) concerning the handling of private information in the services provided on this website (“Services” hereinafter)

Article 1. Private information

“Personal information” included in private information refers to “personal information” as described in the Act on the Protection of Personal Information, meaning information about a living individual that can be used to identify the specific individual by name, date of birth, address, telephone no., contact information, or other description contained in such information.
“Historical information and characteristics” included in private information refers to information other than the above “personal information,” including services used and products purchased, records of webpages and advertisements viewed, keywords used by a user when searching information, dates and times of use, methods of use, usage environments, postal codes, gender, occupation, age, user IP address, information contained in cookies, location information, and device identifier information.

Article 2. Methods of collecting private information

When a user registers to use the Website, the Company may ask for personal information such as name, date of birth, address, telephone no., email address, bank account no., credit card no., or driver’s license no. The Company also may collect from business partners transaction records and payment-related information containing users’ personal information exchanged between users and such partners (including information providers, advertisers, and recipients of advertising; “partners” hereinafter).
The Company collects historical information and characteristics regarding a user when the user uses services or views webpages provided by the Company or a partner. Such information may include services and software used, products purchased, records of webpages or advertisements viewed, keywords searched, dates and times of use, methods of use, usage environments (including telecommunications conditions and various configuration information concerning devices used), IP address, information contained in cookies, location information, and terminal identifying information.

Article 3. Purposes of collection and use of personal information

The Company’s purposes of collection and use of personal information are described below.

  • (1) For purposes of displaying information related to registration information such as name, address, contact information, and payment method, services used and products purchased, and the prices thereof, so that the user him or herself can view and modify registration information and view information on his or her usage
  • (2) For purposes of using email addresses to provide notices to or to contact users, and use of contact information such as name and address to contact users as necessary for delivery of products
  • (3) For purposes of using information such as name, date of birth, address, telephone no., bank account no., credit card no., driver’s license no., and results of delivery of registered mail to confirm the identity of users
  • (4) For purposes of using payment-related information such as names and quantities of products purchased, types and periods of services used, frequencies of use, billing amounts, name, address, bank account no., and credit card no. to bill users for their charges
  • (5) For purposes of displaying information registered with the Company on input screens and transferring it to other services etc. (including provision to business partners) as instructed by the user, to make it easy for users to enter data
  • (6) For purposes of using information such as states of use and individuals’ names, addresses, and other information to block use by users who have violated the terms of use of the Services, for example by failing to make payment on time or by causing harm to third parties, or users who have attempted to use the services improperly or for inappropriate purposes
  • (7) For purposes of use of information necessary for the Company to provide services to users, such as the content of inquiries and amounts of charges billed in order to respond to inquiries from users, as well as users’ states of usage of services and contact information
  • (8) For purposes related to the purposes of use above

Article 4. Provision of personal information to third parties

Except in the following cases, the Company shall not provide personal information to third parties without first obtaining the consent of the user. However, this does not apply to cases in which such provision is permitted under the Act on the Protection of Personal Information or other laws or regulations.

  • (1) As stipulated by laws or regulations
  • (2) When necessary to protect the life, safety, or property of an individual, and obtaining the consent of the individual concerned would be difficult
  • (3) When particularly necessary for purposes such as improvement of public health or promotion of the healthy growth of children, and obtaining the consent of the individual concerned would be difficult
  • (4) When necessary to cooperate with national governmental bodies or local governmental authorities, or parties entrusted by national government bodies or local governmental authorities to execute affairs as specified by law or regulations, and obtaining the consent of the individual concerned could impede their execution
  • (5) When notice has been provided of the following information, or it has been announced publicly:
    The fact that the purposes of use of such information include provision to third parties
    Items of data provided to third parties
    Means or methods of provision to third parties
    The fact that provision of personal information to third parties will cease if so requested by the individual concerned

Notwithstanding the provisions of the preceding article, the following cases do not qualify as provision to third parties:

  • (1) Subcontracting by the Company of the handling of personal information, in whole or in part, within the scope necessary to achieve the purposes of use
  • (2) Provision of personal information in connection with succession of business operations by another party, due to merger or other reason
  • (3) Joint use of personal information with a specific party after first notifying the individual concerned of the fact of such joint use, the items of personal information used jointly, the scope of parties involved in joint use, the purposes of use of such parties, and the personal names or titles of such parties’ persons responsible for management of the personal information, or making such information available in a state in which it would be easy for the individual concerned to access it

Article 5. Disclosure of personal information

When an individual concerned by personal information has requested its disclosure, the Company shall disclose such information to said individual without delay. However, if such disclosure would result in any of the following cases, the Company may decide not to disclose all or part of such information, and when making such a decision it shall notify the individual of such fact without delay. The Company shall request a fee of 1000 yen/instance for disclosure of personal information.

  • (1) When such disclosure might be detrimental to the life, health, property, or other rights of the individual concerned or a third party
  • (2) When such disclosure might result in a marked impediment to proper execution of the Company’s businesses
  • (3) In other cases in which such disclosure would violate laws or regulations

Notwithstanding the provisions of the preceding paragraph, in principle information other than personal information, such as historical information and characteristics, shall not be disclosed.

Article 6. Correction and deletion of personal information

If personal information held by the Company concerning him or her is incorrect, a user may, through the Company’s specified procedures, ask the Company to correct or delete such personal information.
When the Company has received a request from a user as described in the preceding paragraph and has determined that it needs to accept such request, it shall, without delay, correct or delete the relevant personal information and notify the user thereof.

Article 7. Cessation of use of personal information etc.

When a user has requested the cessation of use or deletion (“cessation of use etc.” hereinafter) of personal information concerning him or her, due to the fact that such personal information is being used beyond the scope of its purposes of use or was collected through improper means, the Company shall without delay conduct the necessary investigation and, based on the results thereof, take steps such as cessation of use etc. of the personal information and notify the user thereof. However, if it would be difficult to take steps such as cessation of use etc. for such personal information because doing so would be highly costly or for other reasons and the Company can protect the user’s rights through other measures, it may take such other measures.

Article 8. Amendments to the Privacy Policy

The content of this Policy is subject to change without notice to users.
Except as the Company specifies separately, an amended Privacy Policy shall take effect upon being posted to this website.
